Terms of Use

These Terms of Use (“Terms”) govern your use of kilimokwanza.org and any of its pages, newsletters, downloads and services (together, the “Site”). The Site is published by AppsValle Limited, a company incorporated in Kenya (“AppsValle”, “we”, “us” or “our”).

By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

1. Information only, not professional advice

All content on the Site, including news, features, series, crop guides, value-chain guides, figures, prices, yields, market statistics, tables and spreadsheets, is published for general information only.

• It is not agronomic, veterinary, legal, financial, investment, tax or other professional advice, and must not be relied on as such.
• Prices, costs, yields, returns and market figures are indicative planning estimates. Actual results vary with location, season, weather, inputs, management, pests, disease and market conditions.
• Farming and agribusiness carry risk. Before acting on anything you read on the Site, you should take advice from a qualified professional, such as an extension officer, agronomist, veterinarian, financial adviser or lawyer, and check local regulations and seed, chemical and animal-health rules.
• Any decision you make based on the Site is your own decision, made at your own risk.

2. Accuracy

We work to be accurate and to correct mistakes promptly (see our Editorial Policy). However, we do not warrant that the content is complete, accurate, current or free of error. Content may be changed, updated or removed at any time without notice.

3. Intellectual property

Unless stated otherwise, all content on the Site, including text, graphics, logos, photographs, tables, guides, downloads and the design and layout of the Site, is © 2026 AppsValle Limited or its licensors, and is protected by the Copyright Act of Kenya and international copyright law. “Kilimo Kwanza” and its logos are our trade names.

You may:

• read, download and print content for your own personal, non-commercial use;
• quote short extracts, provided you give clear credit to Kilimo Kwanza and a link to the original article.

You may not, without our prior written permission:

• republish, reproduce, sell, license, distribute or adapt our content, in full or in substantial part, in any medium;
• remove copyright, attribution or other notices;
• use automated tools (robots, scrapers, crawlers) to copy or harvest content in bulk, except standard search-engine indexing;
• use our content to train, fine-tune or build artificial-intelligence or machine-learning systems, or to create datasets;
• frame or mirror the Site, or present our content as your own.

4. Comments and material you send us

You are fully responsible for any comment, tip, photograph or other material you post on or send to the Site (“User Content”). You confirm that your User Content is your own or that you have the right to share it, and that it is lawful.

You must not post User Content that is defamatory, abusive, threatening, obscene, hateful, discriminatory, false or misleading; infringes anyone’s copyright, privacy or other rights; promotes violence or illegal activity; is spam or advertising; or contains viruses or harmful code.

By posting or sending User Content, you give AppsValle a free, worldwide, non-exclusive, perpetual licence to publish, edit, translate, adapt and use it in connection with the Site and Kilimo Kwanza. We may edit, refuse or remove any User Content at any time, without notice or reason. We do not endorse User Content and are not responsible for it.

5. Acceptable use

You agree not to:

• use the Site in any way that breaks the law, including the Computer Misuse and Cybercrimes Act, 2018 of Kenya;
• attempt to gain unauthorised access to the Site, its server, accounts or database;
• interfere with, overload or disrupt the Site, or introduce malicious code;
• impersonate any person or organisation, or misrepresent your connection with us;
• collect personal data about other users.

We may suspend or block access to the Site, without notice, for anyone who breaches these Terms.

6. Third-party links, advertising and sponsored content

The Site contains links to other websites and may carry advertising, sponsored content and partner material. These are labelled (see our Advertising and Sponsored Content Policy). We do not control and are not responsible for other websites or for the products, services or claims of advertisers and sponsors. Any dealings you have with them are solely between you and them.

7. Availability

We provide the Site “as is” and “as available”. We do not guarantee that it will be uninterrupted, secure, timely or free of errors or viruses. We may change, suspend or withdraw all or part of the Site at any time without notice or liability.

8. No warranties

To the fullest extent permitted by law, AppsValle excludes all warranties, representations and conditions, express or implied, about the Site and its content, including any implied warranties of accuracy, fitness for a particular purpose, quality and non-infringement.

9. Limitation of liability

To the fullest extent permitted by law:

• AppsValle, its directors, employees, contributors, agents and partners will not be liable for any loss or damage of any kind arising from or connected with your use of, or inability to use, the Site, its content or any linked site. This includes, without limitation, loss of crops, livestock, income, profit, revenue, business, investment, savings, data or goodwill, and any indirect, incidental, special, consequential or punitive loss, whether arising in contract, tort (including negligence), breach of statutory duty or otherwise, even if we were told such loss was possible.
• Where liability cannot lawfully be excluded, our total liability to you for all claims together is limited to one thousand Kenya shillings (KES 1,000).

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the law of Kenya, or any rights you have as a consumer that cannot be waived.

10. Indemnity

You agree to indemnify and hold harmless AppsValle, its directors, employees, contributors and agents from and against any claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising from your breach of these Terms, your User Content, or your misuse of the Site.

11. Complaints and takedown requests

If you believe content on the Site is inaccurate, defamatory, infringes your copyright or breaches your rights, write to kilimokwanza.africa@gmail.com with the page address, the content concerned and the reason for your complaint. We will review it promptly and in good faith and, where appropriate, correct, update or remove the content or offer a right of reply. Making a complaint does not admit any liability on our part.

12. Changes to these Terms

We may update these Terms at any time by posting a new version on this page with a new “Last updated” date. Your continued use of the Site after a change means you accept the updated Terms.

13. Governing law and disputes

These Terms, and any dispute or claim arising from or connected with them or the Site, are governed by the laws of the Republic of Kenya.

Before starting any legal proceedings, you agree first to write to us at kilimokwanza.africa@gmail.com setting out the dispute, and to give us 30 days to try to resolve it amicably. If it is not resolved, the courts of Kenya have exclusive jurisdiction, except that we may seek urgent or injunctive relief in any court of competent jurisdiction.

14. General

• Severability. If any part of these Terms is found invalid or unenforceable, the rest remains in full force.
• No waiver. If we do not enforce a right, that does not mean we have given it up.
• Assignment. We may transfer our rights and obligations under these Terms. You may not transfer yours without our written consent.
• Entire agreement. These Terms, together with our Privacy Policy, Editorial Policy and Advertising and Sponsored Content Policy, are the whole agreement between you and us about the Site.
• Events beyond our control. We are not responsible for any failure or delay caused by events outside our reasonable control.
